MAPA Antitrust Policy
State and federal antitrust laws are intended to protect competition. The MAPA Compliance Forum conducts its business in compliance with the antitrust laws and expects its members to do likewise. MAPA would like to take this opportunity to reinforce its commitment to antitrust compliance and to remind all attendees that violating the antitrust laws can have extremely serious consequences for companies and individuals, including triple damages and criminal penalties. The antitrust laws prohibit actual or potential competitors from agreeing on certain subjects. These include prices, bids, customers and territories they will serve, strategic plans and employee salaries and benefits. Here is a brief list of “off limits” topics that competitors should not discuss with each other and should not reach agreement on:
- Current or future prices of the products and services your company sells;
- Discount policies;
- Credit terms;
- Prices your company pays for the products and services it buys;
- Strategic plans, including new product introductions and new territories;
- Bids your company has submitted or plans to submit to customers;
- Customers or territories your company serves;
- Not doing business with certain customers or vendors;
- Salaries and benefits of employees; and
- Not hiring each other’s employees.
Most importantly, your company should make its business decisions unilaterally, without consulting competitors.
